Many of our clients have questions about marital and nonmarital assets. For example, people tend to think that because they have a separate bank account, what is in that accounts is theirs alone.
This is not true. Marital property is any property acquired during the marriage, by either party. This includes work income, retirement accounts and numerous other assets. This is true of many types of debt as well.
Separate property, on the other hand, is property acquired prior to the marriage, named as such in a premarital agreement, or gained through an inheritance or personal injury lawsuit.
